NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by the virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 31, 2006, executed by the Borrower, Cathy L. Michael, to Barry Dobson and Mark A. McCoy, the Trustees, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 864, at Page 617. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2639 Jamison Rd., Fairview, WV 26570. Pill & Pill, PLLC was appointed as Substitute Trustee by a SUBSTITUTION OF TRUSTEE dated March 21, 2024, of record in the Clerk's Office in Book 1339, at Page 16. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia on the following date:

September 30, 2025, at 4:30 p.m.

All that certain property situated in the District of Paw Paw, in the County of Marion, State of West Virginia, and being described as follows: Map 10 Parcel 35. Being more fully described in a deed dated 08/20/02 and recorded 08/28/02, among the land records of the County and State set forth above, in Deed Volume 978 and Page 769.

More particularly described therein as follows:

Lot No. 7 of the David Thompson lands allotted to Eliza Keefover, more particularly bounded and described as follows, to-wit:

BEGINNING at a 1/2 inch reinforcing rod (set) standing on the northern right of way limits of West Virginia State Route 218 (formerly Route 15), making a corner to Lot No. 6 of the David Thompson lands partition (see partition recorded in Deed Book 181, Page 58) as conveyed to Walden E. and Josephine M. Toothman by deed recorded in Deed Book 901, Page 406, and marking a corner to a parcel conveyed to the State Road Commission of West Virginia by deed recorded in Deed Book 527, Page 397; thence with said limits of Route 218 and said State Road parcel, South 87 59 10 West 181.75 feet to a 1/2 inch reinforcing rod (set), said rod marking a corner to Lot No. 8 of said Thompson partition as conveyed to Virginia Sloan Haught by deed recorded in Deed Book 895, Page 330; thence with said Lot No. 8, North 06 09 20 West 962.13 feet to a 1/2 inch reinforcing rod (set), said rod standing in a line of a parcel conveyed to Robert Thomas Carr, Sr. and Ruth E. Carr by deed recorded in Deed Book 745, Page 327; thence with said Carr parcel, South 77 38 00 East 198.00 feet to a 1/2 inch reinforcing rod (set), said rod marking a corner to said Lot No. 6; thence with said Lot No. 6, South 05 45 00 East 912.39 feet to the beginning, containing 173,052 square feet or 3.9727 acres, more or less, as shown upon a plat prepared by Greenleaf Surveying Company dated August 22, 2002, a copy of which is attached hereto and made a part of this description.

AND BEING the same real estate conveyed unto Cathy L. Michael by the Deed dated the 20th day of August, 2002, from Claude J. Swiger, Jr., Executor of the Estate of Nerva Hazel Keefover, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 978, at Page 769.

TERMS OF SALE:
1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Codesect.11-22-1.

3) The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after foreclosure sale will be deeded to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the sate of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale.

NOTICE is hereby given that Hope Gas, Inc. (the "Company"), a public utility, has filed with the PUBLIC SERVICE COMMISSION OF WEST VIRGINIA, an application containing decreased rates, tolls and charges for furnishing natural gas service to all of its customers at various locations in the Counties of Barbour, Boone, Braxton, Cabell, Calhoun, Clay, Doddridge, Fayette, Gilmer, Harrison, Jackson, Kanawha, Lewis, Lincoln, Logan, Marion, Marshall, Mason, McDowell, Mingo, Monongalia, Nicholas, Pleasants, Preston, Putnam, Raleigh, Randolph, Ritchie, Roane, Taylor, Tucker, Tyler, Upshur, Wetzel, Wirt, Wood and Wyoming.

The proposed decreased rates and charges will become effective November 1, 2024, unless otherwise ordered by the Public Service Commission and will decrease revenues approximately $33.1 million annually, a decrease of 16.63%. The average monthly bill for the various classes of customers will be changed as follows:



1/ To account for an increase in standby rate.







Resale customers of the Company include Consumers Gas Utility Co., Cardinal Natural Gas Company - Northern Division (Lumberport), Mountaineer Gas Co., and Cardinal Natural Gas Company - Northern Division (Blacksville).

The decreases shown are based on averages of all customers in the indicated classes. Each class may receive a decrease greater or less than stated here. Individual customers may receive decreases that are greater or less than average. Furthermore, the requested decreased rates and charges are only a proposal and are subject to change (increase or decrease) by the Public Service Commission in its review of this filing. Any increase or decrease in rates and charges will not become effective until authorized and approved by the Public Service Commission. (If a hearing is conducted, notice will be given of the time and place of hearing.)

A complete copy of the proposed rates, as well as a representative of the Company to provide any information requested concerning it, is available to all customers, prospective customers, or their agents at the Morgantown office of the Company, 781 Chestnut Ridge Road, Suite 100, Morgantown, West Virginia.

Failure to timely intervene can affect your rights to protest any rate increases or to participate in future proceedings.
