Beginning at an iron pin in the northwest corner of the parcel described as Lot 51 on the attached plat and running S. 74deg. 04' 54" E. 62.27 feet to an iron pin; thence N. 85deg. 26' 24" E. 204.88 feet to an iron pin; thence SL. 5deg. 06' 52" E. 317.56 feet to an iron pin; thence N. 88deg. 07' 50" W. 309.24 feet to an iron pin; thence N. 3deg. 11' 01" E. 307.46 feet to the place of beginning, containing 2 acres, more or less
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 120 Timberline Drive, Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to Beverly J. Thomas and James Allen Smith, Jr., by Deed dated February 3, 2003, from Billy G. Nestor and Lois J. Nestor, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 982, at Page 387.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
